Instagram Competition – Terms & Conditions
1. Promoter
The promoter of this competition is TotalEnergies Marketing Australia Pty Ltd (ABN 15149501922), of 360 Elizabeth Street, Melbourne VIC 3000 (“Promoter”).
This promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram.
By participating in this promotion, entrants release Instagram from any responsibility or liability arising in connection with the promotion.
2. Eligibility
Entry is open to Australian residents aged 18 years or over.
Employees of the Promoter, its related companies, advertising or promotional agencies, and their immediate family members (including parents, siblings, spouses, children and members of their household) are not eligible to enter.
The Promoter reserves the right to verify the eligibility of any entrant, including proof of age and Australian residency.
3. Competition Period
The competition opens at 8:00am AEST on 4th September 2026 and closes at 11:59pm AEDT on 4 October 2026 (“Competition Period”).
Entries received outside the Competition Period will not be accepted.
4. How to Enter
To enter, eligible participants must, during the Competition Period:
1. Like the competition post on Instagram;
2. Follow @totalenergies_au on Instagram; and
3. Leave a comment on the competition post.
Entry is free and no purchase is necessary.
Only one (1) valid entry is permitted per person.
Where a person operates multiple Instagram accounts, only one (1) entry submitted by that person will be accepted.
Multiple comments, tags or attempts to enter will not result in additional entries.
The Promoter may deem an entry invalid where the entrant has not complied with these Terms and Conditions.
Any Instagram account used to enter must be a genuine account belonging to a real individual. Entries submitted using fake, fraudulent, automated or otherwise invalid accounts may be rejected.
5. Prize
The prize consists of:
Two (2) Visa prepaid cards valued at AUD $500 each, for a total prize value of AUD $1,000.
The prize is not transferable or exchangeable and cannot be redeemed for cash.
The prize is subject to the terms and conditions of the relevant card issuer.
Any costs or expenses associated with the use of the prize that are not expressly stated in these Terms and Conditions are the responsibility of the winner.
If the advertised prize becomes unavailable for reasons beyond the Promoter’s reasonable control, the Promoter reserves the right, subject to applicable law, to substitute the prize with a prize of equal or greater value.
6. Winner Selection
The winner will be selected by random electronic draw from all valid entries received during the Competition Period.
The draw will take place at 360 Elizabeth Street, Melbourne VIC 3000 on 5 October 2026.
Each valid entry will have an equal chance of being selected.
The Promoter’s decision is final, subject to any rights available to entrants under applicable Australian law.
7. Winner Notification and Redraw
The winner will be notified by Instagram Direct Message within 24 hours of the draw.
The winner may be required to provide reasonable information or evidence to verify their eligibility and claim the prize.
If the winner cannot be contacted, is found to be ineligible, or does not respond within 72 hours of the Promoter’s first attempt to contact them, the Promoter may conduct a further random draw from the remaining valid entries to determine a new winner.
The same verification and notification process will apply to any redraw winner.
The Promoter may publish the winner’s surname, first initial and state or territory of residence on the Promoter’s social media channels and/or website for the purpose of announcing the winner.
8. Prize Delivery
The prize will be delivered to the winner’s nominated Australian mailing address by tracked postage.
The Promoter is not responsible for delays, loss or damage caused by circumstances outside the Promoter’s reasonable control or by the postal service after the prize has been dispatched.
The Promoter is not responsible for an entrant providing an incorrect or incomplete delivery address.
9. Privacy
The Promoter may collect personal information from entrants, including their name, Instagram username, contact details and information reasonably required to verify eligibility and administer the promotion.
Personal information collected in connection with this promotion will be used for the purposes of administering the competition, contacting the winner, delivering the prize and otherwise managing the promotion.
Personal information will be handled in accordance with the Promoter’s Privacy Policy.
By entering the competition, entrants consent to the Promoter collecting and using their personal information for these purposes.
10. Invalid Entries and Disqualification
The Promoter reserves the right to verify entries and to disqualify any entrant whose entry:
- does not comply with these Terms and Conditions;
- is incomplete, misleading or fraudulent;
- is submitted using automated means or an automated entry service;
- involves tampering with or attempting to manipulate the entry process;
- contains content that is unlawful, defamatory, threatening, abusive, obscene, discriminatory, hateful or misleading; or
- is otherwise inappropriate for the Promoter’s social media channels or reasonably considered by the Promoter to undermine the fair operation of the promotion.
The Promoter may remove or hide any comment that breaches these requirements.
The Promoter may also disqualify an entrant where it reasonably believes that the entrant has engaged in fraudulent, misleading or improper conduct in connection with the promotion.
11. Technical Issues and Circumstances Beyond the Promoter’s Control
The Promoter is not responsible for entries that are lost, delayed, incorrectly submitted, incomplete or unable to be processed due to technical problems, network failures, software or hardware issues, Instagram outages or other circumstances outside the Promoter’s reasonable control.
Subject to applicable law, the Promoter reserves the right to amend, suspend or cancel the promotion where reasonably necessary due to circumstances beyond the Promoter’s reasonable control, including technical failures, fraud, unauthorised intervention or other circumstances that may compromise the proper conduct of the promotion.
Any material amendment, suspension or cancellation will be communicated through the Promoter’s Instagram account and/or other appropriate promotional channels.
12. Liability
To the extent permitted by law, the Promoter is not responsible for any loss, damage, claim, expense or injury arising from or in connection with participation in the promotion or acceptance or use of the prize, except to the extent caused by the Promoter’s negligence or otherwise cannot lawfully be excluded.
Nothing in these Terms and Conditions excludes, restricts or modifies any rights, guarantees or remedies that cannot lawfully be excluded, restricted or modified under applicable Australian law, including the Australian Consumer Law.
13. Acceptance of Terms
Participation in this competition constitutes acceptance of these Terms and Conditions.
These Terms and Conditions are governed by the laws of Victoria, Australia.
